Our podcast and related content are also provided for general educational and informational purposes.

AthleteConnect+ is intended to supplement education and communication and is not intended to replace individualized medical evaluation, diagnosis, treatment, rehabilitation, mental-health treatment, or emergency medical care.

Participation in AthleteConnect+, including use of the website, podcast, educational resources, or SMS program, does not by itself create a physician-patient, therapist-client, athletic trainer-athlete, physical therapist-patient, coach-athlete, or other professional healthcare relationship.

Some AthleteConnect+ participants may separately have an established physician-patient relationship with Derrick Burgess, MD, or another healthcare professional. Participation in AthleteConnect+ does not replace or independently define that existing clinical relationship.

6. Text Messaging (SMS) Program

AthleteConnect+ offers an optional text messaging (“SMS”) program that provides enrolled athletes with educational information, injury-recovery content, wellness check-ins, appointment-related reminders, and other information associated with their AthleteConnect+ program.

The AthleteConnect+ SMS program is delivered through the Kimi AI Care Coach platform, powered by RevelAi Health, and may incorporate educational content, Care Journeys, and protocols developed, reviewed, or approved by Derrick Burgess, MD.

AthleteConnect+ SMS communications are intended to supplement education and communication. They are not intended to replace individualized medical evaluation, diagnosis, treatment, rehabilitation, or emergency care.

Information We Collect for the SMS Program

When you enroll in or interact with the AthleteConnect+ SMS program, we may collect and process information including:

• Your mobile telephone number;

• Your SMS enrollment and opt-in information;

• The date, time, and method of your consent;

• Send scheduled educational and wellness messages;

• Provide mental-health, nutrition, performance, and wellness educational content;

• Send appointment-related reminders when applicable;

• Allow you to submit questions and receive program-related responses;

• Personalize educational content based on your enrolled program or Care Journey;

• Operate, secure, monitor, evaluate, and improve the AthleteConnect+ program;

• Troubleshoot messaging or technical issues; and

Consent to Receive Text Messages

Participation in the AthleteConnect+ SMS program is voluntary.

You must affirmatively opt in before receiving recurring SMS messages from AthleteConnect+.

We will not enroll a mobile telephone number in the SMS program without affirmative consent from the individual or, where applicable, authorization from a parent or legal guardian in accordance with applicable requirements.

Consent to receive AthleteConnect+ SMS messages is not a condition of purchasing goods or services or of receiving medical care or other healthcare services from Dr. Burgess.

Acceptance of our general Terms of Service or this Privacy Policy, by itself, does not constitute consent to receive recurring SMS messages.

Mobile Information and SMS Consent

Message Frequency and Charges

Message frequency varies depending on the AthleteConnect+ program or Care Journey in which you are enrolled.

Some programs may continue for several weeks or months, and the number of messages you receive may vary during the course of your participation.

Message and data rates may apply.

Your wireless carrier's standard messaging, data, and other applicable charges may apply to messages sent or received through the program.

AthleteConnect+ is not responsible for charges imposed by your wireless carrier.

Opting Out and Getting Help

You may withdraw your consent and stop receiving recurring AthleteConnect+ SMS messages at any time.

Reply STOP to any AthleteConnect+ text message to opt out.

Other supported opt-out commands may include:

END, CANCEL, UNSUBSCRIBE, or QUIT.

After your opt-out request is processed, you may receive one final message confirming that you have been unsubscribed.

No further recurring AthleteConnect+ SMS messages will be sent unless you subsequently affirmatively opt in again.

Health Information and SMS Communications

Communications through AthleteConnect+ may involve health-related information.

• Connected devices;

• Shared mobile devices;

• Wireless-account records; or

Where applicable, AthleteConnect+ and its service providers will handle protected health information in accordance with applicable healthcare privacy and security requirements and contractual obligations.

Educational Program and Existing Clinical Relationships

AthleteConnect+ provides educational and supportive information intended to help enrolled athletes better understand health, wellness, injury recovery, mental health, nutrition, performance, and related topics.

Participation in AthleteConnect+, including participation in its SMS program, does not by itself establish a physician-patient or other healthcare-provider relationship.

Some AthleteConnect+ participants may separately have an existing physician-patient relationship with Derrick Burgess, MD, or another healthcare professional.

If such a relationship already exists, participation in AthleteConnect+ does not terminate, replace, expand, or independently define that clinical relationship.

AthleteConnect+ educational communications do not replace:

• Scheduled clinical visits;

• Individualized medical evaluation;

• Professional medical advice;

• Diagnosis;

• Treatment recommendations;

• Rehabilitation instructions; or

• An individualized treatment plan provided through an established healthcare relationship.

• Performance-related educational content;

• Program-related communications;

• Appointment-related reminders; and

• Links to educational resources, including articles, videos, podcasts, or other AthleteConnect+ content.

Messages are delivered through the Kimi AI Care Coach platform, powered by RevelAi Health, and may use educational Care Journeys, protocols, and content developed, reviewed, or approved by Derrick Burgess, MD.

3. Educational Nature of the Program

AthleteConnect+ is intended to supplement health and wellness education and communication.

It is not a substitute for individualized medical evaluation, diagnosis, treatment, rehabilitation, mental-health treatment, counseling, or emergency medical care.

Participation in AthleteConnect+, including participation in its SMS program, does not by itself establish a physician-patient or other healthcare-provider relationship.

Athletes may enroll in the AthleteConnect+ SMS program by providing a valid mobile telephone number and affirmatively consenting to receive recurring text messages through an approved enrollment process.

Enrollment may occur through:

• An AthleteConnect+ enrollment form;

• An intake process;

• A participating care team;

• An institutional enrollment process; or

• Another approved method of enrollment.

Providing a mobile telephone number alone does not constitute consent to receive recurring AthleteConnect+ text messages.

Consent to receive AthleteConnect+ text messages is not a condition of purchasing any goods or services or of receiving medical care or other healthcare services from Dr. Burgess.

• Messaging platforms;

• Messaging aggregators;

• Technology providers; and

• Other service providers necessary to operate, support, secure, maintain, or deliver the AthleteConnect+ SMS program.

These providers may process information only as necessary to provide services supporting the AthleteConnect+ program and subject to applicable contractual, privacy, and security requirements.

Text messaging originator opt-in data and consent will not be transferred to third parties for their independent marketing or promotional use.

11. Health Information and SMS Privacy

Because AthleteConnect+ provides health and wellness education, communications exchanged through the SMS program may include health-related information.

Text messaging presents privacy and security risks that differ from communications made through a secure patient portal or other secure healthcare communication system.

SMS messages may appear on:

• A mobile device's lock screen;

• Notification history;

• Connected devices;

• Shared mobile devices;

• Wireless-account records; or

• Other locations accessible to individuals who have access to your device or mobile account.

You are responsible for considering the privacy and security of the device and telephone number you choose to use for AthleteConnect+ communications.

Where applicable, health information will be handled in accordance with applicable healthcare privacy and security requirements and applicable contractual obligations.

12. Use of AI-Assisted Technology

The AthleteConnect+ SMS program may use AI-assisted technology through the Kimi AI Care Coach platform, powered by RevelAi Health, to help deliver educational content, Care Journeys, wellness check-ins, and program-related responses.

AI-assisted responses are intended to support the educational functions of AthleteConnect+.

They are not a substitute for professional medical judgment, individualized diagnosis, treatment planning, emergency care, or direct evaluation by a qualified healthcare professional.

You should not rely on an AI-assisted response for an urgent or emergency medical decision.

13. Not for Emergencies

Do not use AthleteConnect+ text messaging for emergencies, urgent medical conditions, or crisis intervention.

AthleteConnect+ messages may not be reviewed or responded to immediately.

If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency medical care.

If you are experiencing a mental-health crisis or suicidal thoughts in the United States, call or text 988to reach the 988 Suicide & Crisis Lifeline.

14. Acceptable Use

You agree not to use the AthleteConnect+ SMS program to:

• Send unlawful, threatening, abusive, or harassing content;

• Impersonate another person;

• Submit another person's confidential health information without appropriate authorization;

• Attempt to disrupt, damage, or gain unauthorized access to the program or related systems;

• Introduce malicious code or automated abuse;

• Violate another person's privacy or intellectual-property rights; or

• Use the program for any unlawful purpose.

We may suspend or terminate access to the SMS program when reasonably necessary to protect users, security, program integrity, or comply with applicable law.

15. No Guarantee of Response

AthleteConnect+ may permit participants to submit questions or responses through SMS.

We do not guarantee that every message will receive an individualized response or that any response will occur within a particular period of time.

You should not delay obtaining medical care while waiting for an AthleteConnect+ response.

16. Changes to the Program or These Terms

We may modify the AthleteConnect+ SMS program or these SMS Terms from time to time.

When we update these Terms, we will revise the “Last Updated” date above.

If we make material changes, we may provide additional notice where required by applicable law or messaging requirements.

Continued participation in the AthleteConnect+ SMS program following an update constitutes acceptance of the revised SMS Terms to the extent permitted by applicable law.

If a change requires new or renewed consent under applicable law, we will obtain that consent before applying the change.

17. Termination of the SMS Program

We may suspend, modify, or discontinue all or part of the AthleteConnect+ SMS program at any time, subject to applicable law.

Termination of the SMS program does not alter any separate physician-patient relationship or other healthcare relationship that may independently exist.
